BoatsWorld Terms of Use

These terms govern access to and use of BoatsWorld.com and the associated websites operated by David Lyons Garcia, NIF 40356349C (BarcosAVela.com, BarcosAMotor.com, ForumNautico.com, Sailing-Boats.com, BoatsHunter.com, VelaYMotor.com, BoatRentalOnline.com and any other domains displaying these terms).
By creating an account, publishing a listing or using the platform, the user accepts these terms. If you do not agree, you must not use the service.
1. Service provider and contact
The service provider is David Lyons Garcia, NIF 40356349C, at Plaça Independència, 17001 Girona, Spain. You may contact BoatsWorld at [email protected].
2. Nature of the service
BoatsWorld provides an online space for publishing and viewing nautical listings and connecting sellers with interested parties. Unless expressly stated otherwise, BoatsWorld does not own or sell the advertised vessels, does not act as a broker, agent, escrow provider or party to the contract, and does not receive a commission from the sale.
The parties are responsible for checking the other person's identity and capacity, ownership, documentation, liens, condition, safety, tax position and suitability of the vessel, and for completing the transaction safely.
3. Accounts and responsible use
The user must be an adult and have sufficient legal capacity. Users must provide accurate, current information, protect their credentials and remain responsible for activity carried out through their account or organisation. Impersonating others, transferring an account without permission, interfering with the service or using it for unlawful, fraudulent or abusive purposes is prohibited.
4. General listing rules
The advertiser represents that they own the vessel or are authorised to advertise it, and that it exists, is available and may legally be sold or rented on the published terms.
- Each listing must relate to one real vessel in the correct category. Duplicate listings and reusing a listing for a different vessel are not permitted.
- The title, description, specifications, location, condition, availability, images and other information must be complete, consistent, current and truthful. Known defects or material circumstances must be disclosed.
- Photographs must show the advertised vessel, except for images clearly identified as illustrative for new or made-to-order vessels. The advertiser must have the right to use all submitted content.
- The listing must be updated when its details change and marked as sold or rented, or removed, as soon as it is no longer available.
5. Genuine price and contact details
The amount entered must be the genuine asking price for the complete vessel advertised. Symbolic, fictitious, bait or clearly incongruent prices — for example €1, €99, or the amount of an instalment, down payment, deposit or accessory — are not permitted when they do not represent the vessel's sale price.
If the advertiser does not wish to display the price publicly, they must use the dedicated hide-price option; they must not substitute a false amount. The currency, whether taxes are included, and any mandatory component must be stated clearly. Professional sellers must display the total price where required by applicable consumer law.
Telephone numbers, email or website addresses, social media handles, QR codes and other contact instructions may only be entered in the fields specifically provided. They may not appear in the title, description, images or other public free-text fields unless BoatsWorld expressly authorises it. BoatsWorld may mask or remove those details without changing the rest of the listing.
6. Prohibited content and conduct
False, misleading, discriminatory, defamatory, threatening, obscene or unlawful listings or messages, or content infringing third-party rights, are not permitted. Nor are unsolicited advertising, bulk solicitation, malicious links, phishing or attempted fraud; non-existent or unavailable products; content unrelated to the listing; search manipulation; or uses that compromise community safety or trust.
BoatsWorld may request reasonable evidence of identity, ownership, authority, availability, specifications or price. Failure to cooperate may prevent publication or reactivation.
7. Review, deactivation and enforcement
BoatsWorld may review listings through manual or automated controls and correct their formatting, category or presentation without changing the essential meaning. Where a possible breach is detected, it may reduce visibility, temporarily deactivate, block or remove the listing and, where necessary, restrict account features.
In particular, a listing may be deactivated for contact details in non-permitted fields, a fictitious or incongruent price, misleading information, duplicates or signs of fraud. Where circumstances permit, BoatsWorld will state the reason and allow the advertiser to correct it. Reactivation takes place after the remedy has been verified; editing alone does not trigger automatic reactivation.
Serious, repeated or unlawful breaches, or conduct posing a risk to others, may lead to immediate removal, account suspension or closure. Users may request a review by emailing [email protected] and identifying the listing and decision.
8. Responsibility for published data
Listings, images, prices, specifications, messages and other data supplied by advertisers or users are published under the sole responsibility of the person providing them. BoatsWorld does not endorse them, is not required to review every item in advance, and does not warrant their accuracy, completeness, lawfulness, authenticity, availability or currency.
To the fullest extent permitted by law, BoatsWorld and its owner are not liable for errors, omissions, false statements, outdated data or loss arising from reliance on third-party content. This limitation does not affect liability that cannot legally be excluded or duties arising when BoatsWorld obtains actual knowledge of unlawful content. Suspected unlawful, fraudulent or inaccurate content may be reported to [email protected] for review.
Articles, valuations, automatic translations and other general platform information are provided for information only and do not replace an inspection, survey, valuation or professional legal, tax or technical advice.
9. Content licence and translations
Users retain their rights and grant BoatsWorld a non-exclusive, worldwide, royalty-free licence for as long as necessary to provide and promote the service. This allows BoatsWorld to host, reproduce, technically adapt, translate and display the content on associated domains, search engines, social media and the platform's channels.
Translations may be produced automatically and may contain errors. The original text remains the reference version, and the advertiser should review available versions and report any material error.
10. Transactions, privacy and applicable law
BoatsWorld does not guarantee users' identity or solvency, the condition or safety of a vessel, or that a transaction will be completed. Before committing funds, users should inspect the vessel, verify its documents, and use appropriate contracts, payment methods and professional advice.
The processing of personal data is governed by the Privacy Policy. Users must not publish another person's personal data without a lawful basis or collect or reuse data for spam or unsolicited advertising.
BoatsWorld may amend these terms for legal, technical or service changes. The published version will show its update date. These terms are governed by Spanish law, and disputes will be heard by the courts determined by applicable law; where a choice of venue is legally valid, the courts of Girona will have jurisdiction. Nothing limits mandatory consumer rights or excludes liability that cannot legally be excluded.
